HIPAA Updates and Rulemaking
We are expecting changes to HIPAA in 2023 as the proposed rulemaking and comment period ended in 2021. With the COVID flexibilities ending with the PHE end on May 11, 2023, many fear HIPAA enforcement activities will increase going forward.

Rulemaking agencies need to be aware of:

  • CARES ACT – substance abuse sharing of information to allow for treatment but steeper penalties for breaches.
  • 2021 HIPAA Safe Harbors Act -amendment to HIPAA HITECH increasing cybersecurity practices.
  • 21 Century Cures Act called for the HHS to create a new Rule that would improve the flow of healthcare data between providers, patients, and developers of Health IT such    as electronic health record (EHR) vendors.
  • Interoperability and Information Blocking Final Rule in March 2020
  • The Office for Civil Rights has been enforcing violations of the HIPAA Right of Access when timely access to medical records is not provided
    • 43 violations as of January 2023
  • Penalty Structure for Violations of HIPAA Regulations increase in 2023.
  • Proposed new HIPAA regulations announced by OCR

Objectives:

  1. Understand the proposed HIPAA changes and how it effects home health & hospice
  2. Learn who needs HIPAA training and what elements need to be part of that training
  3. Review necessary HIPAA policies which require review and updating annually

HIPAA Information Security
OCR is increasing enforcement activities for HIPAA violations. Department of Health & Human Services’ Office for Civil Rights (OCR) can issue fines to Health Insurance Portability & Accountability Act (HIPPA) covered entities and business associates that fail to implement necessary safeguards to secure protected health information (PHI). The most vulnerable area for agencies is the Security Risk Analysis (SRA). This 60-minute webinar will discuss the two areas of HIPAA compliance essential to home health & hospice.

Objectives:

  1. Understand the necessary components for a solid HIPAA Security Risk Assessment including:
    1. Who should be involved?
    2. When & often do we need to perform the assessment?
    3. What are best practices for performing the assessment? (who, when, how)
  2. Learn the steps for breach mitigation and reporting
    1. What is considered a breach?
    2. What state & federals agencies need to be alerted of the breach?
    3. How do we need to alert our patients affected?

Audience:This series is a necessary topic for Administrators; Compliance; Privacy Officer; Clinical Management; Clinicians; Human Resources; Medical Records and IT.

Instructor:Joan L. Usher, BS, RHIA, HCS-D, ACE-HH, ACE-H, President, JLU Health Record Systems is a nationally recognized expert in record management. She has a degree in Health Information Management and has been a home health and hospice consultant for over 35 years. Joan is past president of the Massachusetts Health Information Management Association (MaHIMA) and has served as a delegate for American Health Information Management Association (AHIMA). She received the Distinguished Member award from MaHIMA in 2017 and the Professional Achievement Award in 2008. Joan is a published author with book topics such as ICD-10-CM Coding, Billing, Clinical Documentation Improvement and contributing author to the Massachusetts Medicolegal Guide. Usher is a current Board of Director of Hospice & Palliative Care of MA and a past Board of Director of the Home Care Alliance of MA.
